Is Google Book Search "Fair Use"?


This is a talk (ok, a long talk, ~30 minutes) about whether Google's Book Search project -- called "massive copyright infringement" by the American Association of Publishers, is "fair use"? It is.

I like google book search and believe it is fair use. However, the thumbnail example is not exactly the same as what google does. Though end-users see a 'thumbnail' or 'transformation' of the book, google has copied the entire work to its personal servers. In the case of the thumbnails, only the transformation was stored on the engine's servers.
